You consent to the following conditions for the collection of data by “US”.

  • Personal data is processed fairly and lawfully in accordance with Article(3).
  • The Processing of Personal data of the subject in accordance with Article(4).
  • The Processing of Sensitive Personal Data of the subject in accordance with Article(5).
  • 1. Personal Data

    1.1- When you use Switcher’s Products and Services, you will be asked to provide contact details which we will then use to deliver the requested information and/or service. If you are using or accessing our Services, When in connection with a paid subscription or purchased service, we may ask for specific information, such as your name, address, e-mail address and phone number for us to be able to perform our obligations under the terms of these Services. In addition, we collect your payment details to be able to process the payment of your subscription fee or purchase price.

    2. Third-Party Websites and applications

    You may access other third-party services through the Services, for example by clicking on links to those third-party services from within the Services. We are not responsible for the privacy policies and/or practices of these third-party services, and we encourage you to carefully review their privacy policies.

    3. Children Policy

    Switcher does not knowingly collect information from children under the age of 18, and children under 18 are prohibited from using our Services.

  • 5. Cookies and Other Tracking Technologies:

    5.1- Session Cookies:

    We use "session" cookies to keep you logged in while you use our Services, to better understand how you interact with our Services, and to monitor aggregate usage and web traffic information on our Services.

    5.2- Persistent Cookies:

    We use "persistent" cookies to recognize you each time you return to our Websites or Services. For example, we create a persistent cookie that includes some basic information about you, like your most recent search. We use this persistent cookie to remember your preferences and, if you create an account, to make your user experience consistent.

    5.3- Log Data:

    Our servers automatically record information created by your use of the Websites or Services (“Log Data”). Log Data includes information such as your IP address, browser type, operating system, the referring web page, web pages visited, location, your mobile carrier, your computer or mobile device type, search terms and cookie information.     6.1- When you use our Services, we may collect information about your engagement with and utilization of our Services, such as processor and memory usage, storage capacity, navigation of our Services, and system-level metrics. We use this data to operate the Services, maintain and improve the performance and utilization of the Services, develop new features, protect the security and safety of our Services and our customers, and provide customer support. We also use this data to develop aggregate analysis and business intelligence that enable us to operate, protect, make informed decisions, and report on the performance of our business.

    7. Information You Provide:

    7.1- Account Registration: When you register for an Account, we may ask for your contact information, including items such as name, company name, address, email address, and telephone number. If you choose to refer a friend to our Services, we may also collect your friend’s email address so that we may send them a referral or promotional code to sign up for our Services.

    7.2- Payment Information: When you add your financial account information to your Account, that information is directed to our third-party payment processor. We do not store your financial account information on our systems; however, we have access to, and may retain, subscriber information through our third-party payment processor.

    7.3- Communications: If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide. We may also receive a confirmation when you open an email from us.

    8. How we Use the Information that we Collect

    We collect your Data for the following purposes with accordance to Articles(3,4,5):

    To send you communications or documents you have requested (such as offers, demonstrations, whitepapers, newsletters and marketing materials);

    8.1- To contact you to ask you if you have any questions about the Services or information that you have requested from us;

    8.2- To communicate with you via email, telephone, text (SMS), postal services, social media and websites regarding Switcher-related news and inform you about Services that may be of interest to you, if you allow us to do so;

    8.3- To respond to your questions or requests for additional information;

    8.4- To set up a regular account for our Services;

    8.5- To provide our Services to you;

    8.6- To share and exchange reports and information with credit reporting agencies, credit bureaus and/or any other entity connected with the use of our payments processing services; and to use third party databases (including registries, licensing authorities, identification services, telecom providers) or references provided by you to obtain or verify information about your financial circumstances, background and to identify and detect fraud;

    8.7- To manage our customer relationship with you and to provide you with customer support;

    8.8- To process payments to us for the Services;

    8.9- To get a better understanding of how you browse our Websites so that we can optimize your experience;

    8.10- To research and analyze your use of or interest in our Services and those products and services offered by others;

    8.11- To analyze the effectiveness of our Services;

    8.12- To improve the functionality of our Websites and Services;

    8.13- To help you find the most relevant information by customizing our Services to optimize your experience;

    8.14- To verify your eligibility and deliver prizes in connection with promotions, contests and sweepstakes;

    8.15- To perform any additional purposes explicitly described to you at the time of collection and for which we receive your consent.

    9. Lawful grounds for processing (Article 4,17,24)

    9.1- In the Kingdom of Bahrain, we can only process your Personal Data if we have a lawful ground to do so. Depending on the processing activity, we can process your Personal Data on the following grounds:

    9.1.1- In order to comply with our obligations under an agreement we concluded with you, such as to provide our Services;

    9.1.2- Where you have freely given your explicit consent and this consent has not been revoked;

    9.1.3- Where we are pursuing a legitimate interest, which is not outweighed by your fundamental rights or freedoms

    9.1.4- In very exceptional cases to protect your vital interests.

    10. Protecting Ourselves and our Subscribers

    10.1- We may release Personal Data when we believe that doing so is appropriate to comply with applicable laws, regulations or legal requests; to enforce or apply our policies and guidelines; to initiate, render, bill, and collect amounts owed to us; to protect our rights or property; to protect the safety of our Subscribers; to address fraud, security or technical issues; to prevent or stop activity that we consider to be illegal or unethical; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay. Without limiting the generality of the foregoing, we may also be required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

    How do we Protect your Personal Data?

    11. Security of processing (Article 8)

    11.1- We treat your Personal Data as private, confidential information and we strive to ensure that Personal Data under our control, regardless of format, is protected and kept secure at all times. Please be aware, however, that no method of transmitting information over the Internet or of storing information is completely secure. Accordingly, we cannot absolutely guarantee the protection of any information shared with us. In the event of an unauthorized loss or disclosure of Personal Data, Visitors, Subscribers and End-Users may be subject to a risk of harm resulting from such loss or disclosure. Depending on various factors, such as the type and amount of Personal Data disclosed, consequences for individuals could include changes to their credit bureau rating or financial situation or identity theft. Lightspeed will at all times comply with applicable laws concerning data breach notification requirements and will endeavor to mitigate any risks of residual harm to the affected individuals.

    12. Confidentiality of Processing data (Article 9)

    12.1- The data collected will not be processed without the consent of the user. And any data that is not mentioned above under point no (4.) shall not be processed in accordance with Bahrain's Law.

    13. Location of Personal Data (Article 12)

    13.1- The collected data will not processed or transferred outside the kingdom of Bahrain, unless in certain situations where the following procedures are applied

    13.1.1- The nature of the data to be transferred, purpose and duration of processing.

    13.1.2- the country or territory of origin of the data, its final destination, and available measures, in such countries and territories, to protect personal data.

    13.1.3- Relevant international agreements and legislations that are in force in the country or territory, which the data shall be transferred to.

    14. Retention of Personal Data:

    14.1- We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax, or accounting requirements).

    15. Accountability for Third Parties:

    15.1- You may access other third-party services through the Services, for example by clicking on links to those third-party services from within the Services. We are not responsible for the privacy policies and/or practices of these third-party services, and we encourage you to carefully review their privacy policies.

    Your Rights in Relation to your Personal Data

    16. Your Choice in Information Use (Article 17, 23, 24)

    16.1- You may unsubscribe from receiving certain promotional emails from us. If you wish to do so, simply follow the instructions found at the end of the email. Even if you unsubscribe, we may still contact you for informational, transactional, account-related, or similar purposes. Many browsers have an option for disabling cookies, which may prevent your browser from accepting new cookies or enable selective use of cookies. Please note that, if you choose not to accept cookies, some features and the personalization of our Services may no longer work for you. You will continue to receive advertising material but it will not be tailored to your interests.

    17. What are my Rights? (Article 18, 19, 20, 21, 23, 24)

    17.1- The customer has the right to Object to Processing for Direct Marketing Purposes.

    17.2- Right to object to processing causing material or moral damage to the User.

    17.3- Right to request rectification, blocking and erasure of data.

    18. Changes to the Privacy Policy

    18.1- From time to time we may change our privacy practices. We will notify you of any material changes to this policy as required by law. We will also post an updated copy on our website. Please check our site periodically for updates.

    19. Security

    19.1- Switcher is committed to protecting your information. To do so, we employ a variety of security technologies and measures designed to protect information from unauthorized access, use, or disclosure. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. However, please bear in mind that the Internet cannot be guaranteed to be 100% secure.
